If you feel that you are a victim of domestic violence, or your safety or that of your child is being threatened, then we can help you apply to court for an injunction. An injunction can be made against a husband, wife, partner or other associated person and it requires them to do or refrain from doing something.
There are two types of injunction that you can seek:
- Non-molestation order: to forbid someone from using violence towards you, harassing, intimidating or pestering you or instructing a third party to do anything they are forbidden to do.
- Occupation order: to require someone to leave the home or only occupy part of the home, or to allow you to return to the home.
At your first appointment we will take details of your relationship, including the history and any relevant incidents. We will prepare a statement and all the necessary documentation. The application can be made with or without notice to the respondent (the person you wish the order to be against). You will need to attend court for the order to be made. We understand that this can be a stressful experience and we will guide you through the process and explain to you what to do if the respondent does not obey the order.
