Mediation is a method of resolving a dispute that avoids the need to go to court. It involves meeting with your former spouse or partner and a mediator to discuss the issues in dispute. The mediator sets out the options available to you and guides the direction of the meeting.
Whether the disagreement is about children or finances, mediation can be used to reach an agreement with the benefit of the mediator’s knowledge and experience.
The mediator facilitates the discussion between the parties of the issues that require resolution, but does not impose a solution on the parties. Mediation is a voluntary process, and the mediator is impartial. If mediation is successful, a Memorandum of Understanding will be drawn up to document the agreement reached. In financial proceedings this can be provided to the parties’ solicitors to prepare the Financial Consent Order.
