Care Proceedings (Court)

Sometimes Social Services will decide that they are not happy with how things are going and therefore the matter needs to be taken to court to allow a Judge or Magistrates to decide who should care for your child/children in the interim (whilst the court proceedings are taking place) and after the court proceedings for the rest of the child/children’s lives.

Social Services may take this action as the next step after Pre-proceedings or they may decide to go to court immediately if their concerns are serious enough. If this happens you will be entitled to the next level of free Legal Aid, which will cover barristers’ fees and any disbursements (payments) that have to be made as part of your case (for example, fees for any reports that may need to be undertaken). Legal Aid will also cover your solicitor’s costs and enable your solicitor to represent and advise you throughout the court process.
