You may require help where a family member is losing or has lost mental capacity and can no longer manage their own affairs. The Court of Protection is responsible for protecting vulnerable people. It aims to prevent the exploitation of vulnerable individuals, to protect what is rightfully theirs and to regulate Deputies, who are people that have been approved to look after the financial affairs of others.
Where a person has lost mental capacity but has not made a Lasting Power of Attorney, anyone wishing to help deal with that person’s affairs must apply to the Court of Protection to be appointed as their Deputy.
